A phone Ap to Draft a Will – A good idea?

This morning, as I was driving to the office, I was listening on the radio about a new smart phone application that creates a Law Will and Testament for you.For what I heard, it even videos the testator makings his/her last Will. It sounds so kool and so easy.

Please BEWARE! At least in Florida, a Will to be valid, must be in writing and executed in accordance withwill-image1-300x199 the Florida Statutes. Among other requirements, a person (the testator) must sign his/her will in the presence of two witnesses and of a notary and they all must sign in the present of each other. This means that all persons, the testator, two witnesses and a notary must be physically present and sign the will all in the presence of each other for the Will to be valid.

This sounds like a very easy thing to accomplish and, as many have told me, who will find out? The truth is, it will be known if the requirements are not met and the will be found to be invalid. When this happens, the testator will no longer be around to fix the mistake.

We are living in a world of technology and convenience but the laws do not change with the creation of an smart phone application. Make sure that before you trust one of these technology gadgets, you confirm that the final product of the document is valid. Do not be deceived.

A: Yes! child support is an obligation and is not contingent on seeing or caring for the child. Even if you do not visit with the child or the other parent interferes in your visitations with the child, you must pay child support.

La aplicacion para accion aplazada (deferred action) ya esta disponible!

Si usted o alguien que usted conoce cumple con los siguientes requisitos, puede enviar su aplicacion inmediatamente:

  • Tenia menos de 31 anos en junio 15, 2012;
  • Vino a los Estados Unidos antes de cumplir 16 anos;
  • Ha residido continuamente en los Estados Unidos desde Junio 15 del 2007 hasta el presente;
  • Estuvo presente fisicamente en los Estados Unidos el 15 de junio del 2012 y en el momento de pedir a inmigracion que considere su aplicacion de action aplazada (deferred action)
  • Entro a los Estados Unidos sin ser inspeccionado antes del 15 de junio del 2012 o su estados legal vencio antes del 15 de junio del 2012;
  • Esta actualmente en “high school,” ya se graduo de high school o obtuvo un certificado de edcuacion general (GED) o es un veterano honorable de la guardia costera o fuerzas armadas de los Estados Unidos; y
  • No ha sido convicto de un delito mayor (felony), un delito menor significativo (misdemeanor), tres o mas delitos menores, y no es considerado una amezada para la seguridad de los Estados Unidos.
